1. Acceptance of Terms

By accessing or using Swara ("the Service", "we", "us"), you agree to be bound by these Terms of Service. Swara provides technical infrastructure for content creators to manage subscriptions and payments. You must be at least 18 years old to create an account. If you do not agree to all terms, please discontinue use immediately. We reserve the right to update these terms at any time without prior notice.

2. Creator Responsibilities

Creators maintain full ownership and responsibility for the content distributed through their channels. Swara acts solely as a technological facilitator for payments and access management and does not endorse or review creator content. Creators must comply with all applicable local, national, and international laws, intellectual property rights, and the terms of service of any third-party messaging platforms utilized. Creators are responsible for fulfilling the offerings advertised to their subscribers.

3. Payments, Subscriptions & Refunds

Swara facilitates transactions using secure, independent payment processing partners. We do not process or store sensitive financial data directly.

For Subscribers: By subscribing, you agree to the pricing and intervals set by the Creator. All payments are final. Refunds are granted solely at the discretion of the Creator, except in verified cases of technical failure directly attributable to Swara's infrastructure.

For Creators: Earnings are disbursed according to our payout schedule, minus applicable platform and payment processing fees. We reserve the right to withhold payouts in cases of suspected fraud, chargebacks, or violations of these terms.

4. Prohibited Activities & Content

You agree not to use the Service to facilitate or promote:

  • Illegal activities, including the sale of illicit goods or services.
  • Unauthorized distribution of copyrighted or trademarked material.
  • Explicit adult content, gambling, or lotteries without proper regulatory licensing.
  • Hate speech, harassment, terrorism, or inciting violence.
  • Fraudulent schemes, money laundering, or malicious software distribution.

We reserve the absolute right to suspend or terminate accounts and freeze funds if we determine a violation has occurred.

5. Service Availability & Modifications

While we strive for high uptime, the Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee uninterrupted access and are not liable for downtime caused by our infrastructure providers, payment processors, or third-party messaging platforms. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

6. Limitation of Liability & Indemnification

To the maximum extent permitted by law, Swara and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Service. You agree to indemnify and hold Swara harmless from any claims, damages, or legal fees arising from your breach of these terms or your use of the platform.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Nairobi.
